Department of Justice Joins Legal Challenge to Halt the State of California's Congressional Map
Federal authorities has entered the fray in a lawsuit initiated by California Republicans, aiming to prevent the state's newly approved congressional redistricting map.
This court case, submitted to a US district court, challenges the map supported by Governor Gavin Newsom, which was created in response to a GOP redistricting effort in Texas.
"California's electoral map represents a brazen power grab that violates civil rights and mocks the electoral system," stated the US attorney general.
The Democratic party have expressed confidence that the redistricting plan will withstand legal scrutiny.
"These opponents were defeated in the election and they are likely to face defeat in the judicial system," stated a representative for the governor.
Legal Basis
The legal challenge claims that California's map improperly used racial considerations to heavily favor Hispanic voters in contravention of the federal constitution.
"It is unconstitutional to use race as a proxy to further partisan goals, but that is exactly what the California General Assembly did with the redistricting measure," argued a senior official from the DOJ's civil rights unit.
Political Context
The legal battle represents the major response by Democrats in the ongoing redistricting war that began in Texas and has spread across various parts of the country.
Unlike other states, where GOP-controlled legislatures have implemented partisan maps, California's plan needed public consent, which it obtained with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to flip just a small number of GOP-controlled House seats to take control of the chamber in next year's midterm election.
The political group controlling the controlling share will influence the remaining period of the sitting president's term, determining whether a unified Republican Congress will persist in implementing its agenda or encounter opposition, congressional probes and possible additional obstacles.
